Our websites https://supportedschool.com, https://mobilemtss.com (the "Site") are committed to protecting your privacy. This Privacy Policy explains how TurnerDEV LLC ("Company," "we," "us," or "our") collects, uses, and discloses information about you when you visit our Site or use our services (the "Services"). By using our Site, you consent to this Privacy Policy.

Our role and your school's agreements

The Services are provided to schools and school districts. When a school or district makes the Services available to you, or uploads or authorizes the upload of student records, we act on that school's or district's behalf and under its direction with respect to that information. If your school or district has entered into a separate written agreement with us (such as a service contract, data privacy agreement, or student data protection addendum), that agreement governs our handling of the information covered by it, and controls over this Privacy Policy to the extent of any conflict.

"Student Information" defined

In this Privacy Policy, "Student Information" means information that relates to an identified or identifiable student and that is provided to, or collected by, the Services by or on behalf of a school or district — including, without limitation, a student's name, contact information, school and enrollment details, demographic information, and any records, notes, referrals, plans, assessments, or other content created or maintained about that student through the Services. Student Information includes "education records" as defined under FERPA and "covered information" as defined under applicable state student-privacy laws.

Information we collect

We collect information that you provide to us, such as your name, email address, and other contact information when you create an account or use our Services. We also collect information about your use of our Site, such as your IP address, browser type, and operating system.

Information provided by users

We may also receive information when other users, such as school or district staff, provide content or information to us. Such information may include Student Information, contact information, or information related to you. When you upload Student Information or information about student parents or other third parties, you are expressly representing that you have the full right and authority to upload that information in accordance with this Privacy Policy and, if required under applicable law, that you have received any consent required from the student or the parent or guardian of the student to upload it to the Services. You expressly agree to use and disclose any information you upload to, or learn from, the Services only for the original purpose for which it was collected and in accordance with applicable law, including without limitation FERPA and COPPA. You will be solely liable for any consequences of your failing to comply with your obligations. We will only use Student Information as reasonably necessary to provide, secure, and support the Services, or as otherwise directed by your school or district.

How we use your information

We use account and usage information to provide the Services, to authenticate and secure accounts, to communicate with you about the Services, to provide support, and to maintain and improve the Site. We use Student Information only to provide, secure, and support the Services for the school or district, and as directed by the school or district — not for our own independent purposes.

We do not use Student Information to serve advertising or targeted advertising, to build a personal profile for any purpose other than providing the Services, or for any other commercial purpose. We do not sell Student Information, and we do not use Student Information to send promotional or marketing materials.

Any promotional or product-announcement communications we send are limited to the school-staff account holders who register to use the Services, are never directed to students, and never use Student Information. You can opt out of these announcement communications at any time as described under "Your choices" below.

How we share your information

We do not sell your information, and we do not share your information with third parties for their own advertising or marketing purposes. We share information with service providers ("subprocessors") that help us operate the Services and only to the extent needed to provide them — namely cloud hosting and storage (Microsoft Azure, in the United States), email and SMS delivery for notifications you or your school configure, and, where your district and school have enabled the artificial-intelligence features, an AI processing provider as described below. On our public pages only, and only for visitors who are not signed in, we also use an analytics provider (Google) as described under Cookies below. Our subprocessors are contractually bound to protect the information and to use it only to provide services to us. We may also disclose information where required by law, court order, or valid legal process, or to protect the rights, safety, or security of users, the public, or the Services.

Artificial intelligence features

The Services may include optional artificial-intelligence ("AI") features that help summarize, draft, or analyze information within the Services. These features are made available at the discretion of your district and school and may be enabled or disabled by them; where they are not enabled, information is not sent to the AI provider. Where the features are enabled and used, the relevant information is processed by our third-party AI provider (OpenAI) solely to generate a response and return it to the Services. Per our provider's applicable business terms for its interface (API), information submitted through it is not used to train the provider's models. To further protect students, the Services are designed so that designated direct identifiers — including a student's first, middle, and last name and student identification numbers — are redacted from information before it is transmitted to the AI provider, and are restored only within the Services after a response is returned. Because the AI features may process free-text entered in the Services, you agree not to include student names or other direct identifiers in free-text fields within the Services (for example, notes, descriptions, and comments). AI-generated output may be inaccurate, incomplete, or not suitable for a particular situation. It is provided to assist, not replace, the professional judgment of educators and staff, and you should independently review and verify AI-generated output before relying on or acting on it. AI features are not to be used for emergency or safety-critical decisions.

Children's privacy

Accounts on the Services are intended for school and district staff who are at least 18 years old. The Site and Services are not directed to children, and we do not knowingly permit children to create accounts or provide information to us directly. Student Information is provided to the Services by schools and districts (or their staff) acting under their authority as educational institutions, including, where applicable, the "school official" provisions of FERPA and the authority of schools to consent on a parent's behalf under COPPA for use limited to the educational context. We use Student Information only to provide the Services as described in this Privacy Policy.

How we protect your information

We take reasonable administrative, technical, and physical measures to protect information from unauthorized access, disclosure, and misuse. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

If we become aware of a security breach resulting in the unauthorized disclosure of Student Information, we will notify the affected school or district without unreasonable delay, consistent with applicable law and any legitimate needs of law enforcement, and will cooperate with the school or district in meeting its notification obligations.

Data retention

We retain account information and Student Information for as long as reasonably necessary to provide the Services to your school or district, or as otherwise directed by the school or district. Upon termination of a school's or district's use of the Services, or upon its written request, we will make the school's or district's data available for export in a commonly used format, and will thereafter delete or de-identify it within a reasonable period — except where retention is required by law or for limited purposes such as security, backup integrity, and record-keeping. Residual copies in routine backups are removed as those backups expire in the ordinary course.

Your choices

You may opt out of receiving announcement and other promotional communications from us at any time by adjusting the settings in your account, by using the opt-out link included in those communications, or by contacting us at support@turnerdev.org.

Opting out of announcement communications does not stop transactional, operational, service, or emergency and safety-related messages. These messages — for example, account and sign-in messages, and support or emergency notifications — are part of the Services your school uses, and we will continue to send them so long as you or your school use the corresponding features. These operational notifications are controlled separately from marketing preferences: a support-team member can pause their support and emergency notifications in their account settings, and you can reply STOP to any text message to stop SMS messages to that number (which also removes it from text-message alerts). Because turning off these operational notifications can stop safety-related messages, you should not rely on the Services as your only means of receiving emergency information. If you are unsure which settings apply to you, ask your school or district administrator. You may also disable cookies in your browser as described below, but this may affect your use of the Site.

If you are a parent or guardian receiving notifications that a school or district has configured, you can stop those messages at any time by using the opt-out link included in them. Requests to review, correct, or delete a student's information should be directed to the student's school or district, which controls that information; we support schools and districts in responding to those requests.

Cookies

We use cookies and similar technologies to operate the Site and to understand how it is used. Strictly necessary cookies keep you signed in, secure submitted forms, and maintain your session. On our public pages, and only when you are not signed in, we also use analytics loaded through Google Tag Manager to understand aggregate usage and improve the Site — we do not load analytics inside the signed-in application. We do not use cookies to serve advertising, and we do not permit third parties to use cookies on the Site to collect Student Information for their own purposes. You can control cookies through your browser settings, though disabling strictly necessary cookies will prevent you from signing in. For details, see our Cookie Policy.

Changes to this Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by email or by posting a notice on the Site, and we will update the "last updated" date above.
